Securities class action accuses Alphabet of misleading investors about Gemini 3.5 Pro's June launch (Stewart v. Alphabet)
On Oct 2, 2026 investor Chris Stewart filed a proposed securities class action in the Northern District of California against Alphabet, CEO Sundar Pichai and CFO Anat Ashkenazi. The complaint says Alphabet promised Gemini 3.5 Pro for June 2026 without disclosing that the model's training results were disappointing. Alphabet fell 4.4% on July 16, when Bloomberg reported the model was months behind schedule. Google never shipped Gemini 3.5 Pro and released Gemini 4 Argon on Sept 30 instead.

What happened
A shareholder sued Alphabet over the Gemini 3.5 Pro delay. At I/O 2026 Google promised the model for June, but it slipped and was eventually replaced by Gemini 4 Argon. The complaint says management knew of poor training results while still promising a June launch.
Why it matters
This is one of the first securities-fraud suits built around a frontier model's training going badly. It raises the question of how much a public company must disclose when a closely watched model underperforms internally. The case is at its earliest stage. Lead-plaintiff motions are due Nov 30, 2026, and a motion to dismiss would normally come before any discovery.
