Federal appeals court pauses Minnesota's first-in-the-nation AI 'nudification' ban in xAI's First Amendment lawsuit
On Friday Oct 2, 2026 the 8th US Circuit Court of Appeals granted Elon Musk's xAI an injunction pending appeal. This blocks for now Minnesota's ban on AI "nudification", which took effect Aug 1, 2026. The law bars website operators, software developers and others from letting users create realistic images of intimate body parts not shown in an original photo of an identifiable person. xAI argues it violates free speech. Minnesota says it targets the "staggering amount" of child sexual abuse material produced by tools such as Grok Imagine. A district judge had refused to block the law in July and again in September.
Key facts
- Court: 8th US Circuit Court of Appeals (St. Louis); injunction pending appeal granted Oct 2, 2026 (Reuters)
- Law: Minnesota's first-in-the-nation anti-nudification law, effective Aug 1, 2026; passed 197–1 across both chambers (Minnesota AG). Per The Week, intimate parts are defined broadly and providers face up to $500,000 per image plus treble and punitive civil damages
- Lower court: US District Judge Donovan Frank denied a temporary restraining order (July 31) and a preliminary injunction (early September), finding no irreparable harm and saying xAI waited too long to seek emergency relief
- xAI's arguments: the law lacks exceptions for artistic, political or journalistic images and has 'no consent element and no scienter requirement' (The Week)
- Minnesota AG spokesperson John Stiles: the law aims to 'combat the spread of a staggering amount of child sexual abuse material that AI products like Grok Imagine generate'
- AG Keith Ellison (July 31): 'These nudification apps, including Grok Imagine, have been used to generate child sexual abuse materials and harass people in the vilest ways imaginable'
What happened
xAI sued Minnesota Attorney General Keith Ellison in late July 2026, just before the state's anti-nudification law took effect. After losing twice in district court, it won an injunction pending appeal from the 8th Circuit, so the law cannot be enforced while the appeal proceeds.
Why it matters
It is the first appellate test of a state law that targets AI image generators themselves, not only the people who share the images. The outcome will shape whether states can regulate generative tools such as Grok Imagine directly, or whether the First Amendment limits them to punishing the distribution of harmful images.
