Utah lets Nolla Health's AI issue initial acne prescriptions, the first US state-authorized AI to write new prescriptions, with physician review phased out in stages

On Oct 5, 2026 Nolla Health said its Nolla Derm app is issuing AI-generated initial acne prescriptions to adults in Utah under an agreement with the state's Office of Artificial Intelligence Policy. It calls itself the first organization a US state regulator has authorized to let AI write a new prescription rather than a refill. A physician approves the first 100 patients' prescriptions in advance; after that, review becomes retroactive (daily, then weekly samples). Utah expanded its health-AI sandbox at the same time and said third-party auditors will check pilots.

What happened

Nolla Health announced on Oct 5, 2026 that Nolla Derm, its acne app, now issues AI-generated initial prescriptions to Utah residents aged 18 and over. This runs under a regulatory agreement with Utah's Office of Artificial Intelligence Policy (OAIP), which can waive state rules for supervised AI pilots, and was coordinated with the Utah Medical Board. Patients complete an intake questionnaire and a face scan. The AI chooses only from pre-approved topical treatments, and cases it is unsure about go to physicians.

Human sign-off is removed in stages. A physician approves every prescription for the first 100 patients. Up to 500 patients, the AI prescribes on its own and a physician reviews the decisions daily. After that, review falls to weekly samples. Bloomberg (paywalled, seen only as a headline summary) called it a first-of-its-kind US pilot of AI diagnosing and prescribing without direct human oversight.

STAT reported that the same day the OAIP expanded its health sandbox with more prescription and women's-health pilots, and, answering critics, signed up independent evaluators to audit the pilots.

Why it matters

Utah had already let Doctronic's AI renew existing prescriptions (from Dec 2025/Jan 2026). Nolla's pilot moves state-sanctioned autonomous AI to new diagnoses and first prescriptions, a step US medical boards have so far reserved for licensed clinicians. The staged removal of human review and the third-party audits make it a test case for other states and for the FDA/state-licensing debate. The 96% agreement figure is the company's own and has not been independently verified.
