Plaintiffs ask the federal JPML to consolidate nationwide lawsuits accusing xAI's Grok of generating sexual images of minors
On Oct 5, 2026 Texas-based Potts Law Firm asked the US Judicial Panel on Multidistrict Litigation to centralize the federal suits, pending in several districts, that accuse xAI's Grok of generating sexually explicit images of real minors from their photos. The proposed MDL is "In re: Artificial Intelligence Minor Sexual Exploitation Litigation" (JPML No. 1:26-P-49). The firm filed its first such suit on July 23, 2026 in Arkansas, citing Grok's "Spicy" and "Unhinged" modes.

What happened
Since July 2026 a plaintiffs' firm has filed federal suits accusing xAI of letting Grok's image tools turn real photos of children into sexual imagery. On Oct 5 it asked the JPML to gather those cases into one multidistrict litigation, the usual step once similar product-liability claims pile up across districts.
Why it matters
If the panel agrees, it would create the first MDL about a generative-AI model producing child sexual abuse material, putting xAI's safeguards, warnings and design choices (e.g. the "Spicy" mode) into one shared discovery process. This comes days after the Eighth Circuit sided with xAI against Minnesota's nudification ban and the IWF reported a surge in AI CSAM.
